Sale conditions are for the purchase of products and services made by telephone, email and through our website www.lagorataormina.com managed by L’Agorà di L. Consoli, registered in Italy, 98039 Taormina (Me), Corso Umberto I, n° 133 – VAT IT 03196610830 – Tax Code CNS LRN 78A 04C 351 H
These conditions govern purchases made through the website www.lagorataormina.com in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree n. 206/2005, amended by Legislative Decree. n. 21/2014 and by Legislative Decree 70/2003 for electronic commerce.
ART. 1 – TERMS OF CONTRACT
Through the general terms and conditions of sale, L’Agorà di L. Consoli sells to the Customer mobile tangible property as offered for sale through the website www.lagorataormina.com
The contract is concluded through purchase of items from the website www.lagorataormina.com and the completion of sale according to the procedure provided by the site itself.
The customer undertakes to read all general conditions of sale prior to confirming the purchase order, and in particular the pre-contractual information provided by L’Agorà di L. Consoli.
Such acceptance is considered tacit unless otherwise communicated with any modality from or to the Customer.
ART. 2 – PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER
Before concluding the purchase contract, the Customer can examine the details and particulars of the goods as illustrated in the individual product sheets.
Before finalizing payment, the Customer is informed about:
- total price of the goods including taxes, shipping costs and any other additional costs that may be incurred;
- terms of payment;
- conditions, terms and procedures for exercising the right of withdrawal;
- information regarding the Customer being responsible for all return costs for any goods purchased;
- the legal guarantee of conformity for the purchased goods;
- after-sales assistance and commercial guarantees provided by:

ARTICOLO 3 – CONCLUSION AND EFFECTIVENESS OF THE CONTRACT
The sales contract is concluded with an order confirmation email from L’Agora di L. Consoli sent to the Customer.
The email contains the Customer’s contact information, order number, cost of the goods purchased, shipping costs, and the delivery address to which the items will be sent.
It is the Customer’s responsibility to verify the accuracy of the personal information and to promptly notify L’Agorà di L. Consoli of any changes to be made. L’Agorà di L. Consoli undertakes to describe and represent the items sold on the website in the best possible way.
Nevertheless, some variations between the images of the product depicted on the website and the actual product may occur.
ARTICOLO 4 – AVAILABILITY OF PRODUCTS
The availability of the product refers to the actual availability at the time the Customer confirms the order.
If for any reason the item should no longer be available once the order has been confirmed, the customer will be immediately notified by email and the order will be canceled. Any sums paid will also be reimbursed in a timely manner.
ARTICOLO 5 – PAYMENT METHODS
Method of payment can be made by the noted credit cards as indicated on the website www.lagorataormina.com, bank transfer or PayPal transaction.
All personal information relating to payment, credit card details and personal data are security protected.
ARTICOLO 6 – Prices
All sales prices of the products indicated on the website www.lagorataormina.com are expressed in Euros and include VAT, and where applicable the WEEE contribution.
Shipping costs are not included in the purchase price but will be calculated and indicated prior to payment.
The Customer accepts the right of L’Agorà di L. Consoli to change its prices at any time, however the goods will be invoiced on the basis of the prices advertised on the website at the time the order is created and will be outlined in the confirmation email sent by L’Agorà di L. Consoli to the Customer.
In the event of a technical or manual issue causing the retail price shown to make it either inordinately high or derisorily low, the purchase order will be considered invalid and cancelled, and the amount paid by the customer will be refunded within 14 days from the day of cancellation.
ARTICOLO 7 – RIGHT OF WITHDRAWAL
In accordance with the legal provisions in force, the Customer has the right to cancel the purchase for any reason without penalty within 14 days from the date of receipt of the products.
The Customer who intends to exercise the right of withdrawal must notify L’Agorà di L. Consoli by means of an explicit declaration containing the decision to cancel the contract.
In case of exercising the right of withdrawal, the Customer is required to return the goods within 14 days from the day on which it was communicated to L’Agorà di L. Consoli the intent to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005.
The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment) and complete with the attached tax documentation to L’Agora di L. Consoli, Corso Umberto I, N° 133, Taormina (Me) 98039.
Without prejudice to the right to verify compliance with the above, L’Agorà di L. Consoli will refund the amount of the products within a maximum period of 14 days.
The customer can use any means of shipping to return the goods. All shipping costs will be at the Customer’s expense (art 56 co. 2 legislative decree 206/2005).
As required by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, L ‘Agorà di L. Consoli may suspend the reimbursement until receipt of the goods or until the Customer demonstrates evidence that product was returned to L ‘Agora di L. Consoli.
Refund will be made using the same method of payment by the Customer at the time of purchase.
In the case of cancellations for payment made by cash-on-delivery or bank transfer, bank details must be provided to L ‘Agorà di L. Consoli through the Contacts section of the website: IBAN, SWIFT and BIC as necessary for reimbursement.
ARTICOLO 08 – DELIVERY METHODS
The products will be shipped by express courier to the address indicated by the Customer as soon as practicable and no later than 20 days from the time of the order confirmation email as issued by L ’Agorà di L. Consoli.
Shipping costs are as follows:
Shipping to Italy
For orders whose total amount is less than € 300.00, a charge of € 20.00 is required for packaging, shipping and transport costs. For orders of equal or greater amount, shipping will be free of charge.
Insured shipping has a cost equal to 2% of the value of the goods. We recommend this service as protection for valuable item, guaranteeing additional peace of mind in case of direct and material damage that may occur during transport.
Shipping to the EU
For orders whose total amount is less than € 1,000.00 a charge of € 40.00 is required for packaging, shipping and transport costs. For orders of equal or greater amount, shipping will be free of charge.
Insured shipping has a cost equal to 2% of the value of the goods. We recommend this service as protection for valuable items, guaranteeing additional peace of mind in case of direct and material damage that may occur during transport.
Shipping to the rest of the world
For orders whose total amount is less than € 2,000.00, a lump sum contribution of € 60.00 is required for packaging, shipping and transport costs. For orders of equal or greater amount, shipping will be free of charge.
Insured shipping has a cost equal to 2% of the value of the goods. We recommend this service as protection for valuable items, guaranteeing additional peace of mind in case of direct and material damage that may occur during transport.
ARTICOLO 09 – LIABILITY
L ‘Agorà di L. Consoli assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, malfunctions or technical issues, which may affect the ability to execute the order within the time provided by the contract.
ARTICOLO 10 – ACCESS TO THE SITE
The Customer has the right to access the website www.lagorataormina.com for consultation and purchases. No other use, in particular commercial, of the website or its content is permitted. The integrity of the contents of the website, the images or texts, and the related technology used remain the property of L’Agorà di L. Consoli, or of the respective owners of the trademarks noted, and are protected by intellectual property rights.
ARTICOLO 11 – Cookies
The website www.lagorataormina.com uses “cookies”. Cookies are electronic files that record information relating to the Customer’s navigation on the website (pages consulted, date and time of consultation, etc.) and which allow L ’Agorà di L. Consoli to offer personalized service to its customers.
L ’Agora di L. Consoli informs the Customer of the possibility to disable the creation of such files by accessing the Internet configuration menu.
ARTICOLO 12 – INTEGRITY
These General Conditions of Sale consist of all the clauses that make them up.
If one or more provisions of these General Conditions of Sale are considered invalid or declared as such pursuant to the law, regulation or following a decision by a court with jurisdiction, all other provisions will continue to retain full force and effect.
ARTICOLO 13 – APPLICABLE LAW AND COMPETENT COURT
The sales contract between the Customer and L. Consoli’s Agora is concluded in Italy and governed by Italian law.
For the solution of civil and criminal disputes deriving from the conclusion of this remote sales contract, the territorial jurisdiction is exclusively that of the Court of Messina.
