Consoli sells to the Customer mobile tangible property as offered for sale through the website <strong>www.lagorataormina.com <\/strong><\/p>\n<p class=\"p1\">The contract is concluded through purchase of items from the website www.lagorataormina.com and the completion of sale according to the procedure provided by the site itself.<\/p>\n<p class=\"p1\">The customer undertakes to read all general conditions of sale prior to confirming the purchase order, and in particular the pre-contractual information provided by L&#8217;Agor\u00e0 di L. Consoli.<\/p>\n<p class=\"p1\">Such acceptance is considered tacit unless otherwise communicated with any modality from or to the Customer.<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>ART. 2 &#8211; PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER<\/b><\/span><\/p>\n<p class=\"p1\">Before concluding the purchase contract, the Customer can examine the details and particulars of the goods as illustrated in the individual product sheets.<br \/>\nBefore finalizing payment, the Customer is informed about:<\/p>\n<ul>\n<li class=\"p1\">total price of the goods including taxes, shipping costs and any other additional costs that may be incurred;<\/li>\n<li class=\"p1\">terms of payment;<\/li>\n<li class=\"p1\">conditions, terms and procedures for exercising the right of withdrawal;<\/li>\n<li class=\"p1\">information regarding the Customer being responsible for all return costs for any goods purchased;<\/li>\n<li class=\"p1\">the legal guarantee of conformity for the purchased goods;<\/li>\n<li class=\"p1\">after-sales assistance and commercial guarantees provided by:<\/li>\n<\/ul>\n<p class=\"p1\"><span class=\"s1\">L\u2019 Agor\u00e0 di L. Consoli<br \/>\n<\/span>Corso Umberto I, n\u00b0133<br \/>\n98039 &#8211; Taormina (Me)<br \/>\nTel.: +39 0942 23091<br \/>\n<span class=\"s2\"><a href=\"http:\/\/www.lagorataormina.com\">www.lagorataormina.com<\/a><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>ARTICOLO 3 &#8211; CONCLUSION AND EFFECTIVENESS OF THE CONTRACT<\/b><\/span><\/p>\n<p>The sales contract is concluded with an order confirmation email from L\u2019Agora di L. Consoli sent to the Customer.<\/p>\n<p>The email contains the Customer&#8217;s contact information, order number, cost of the goods purchased, shipping costs, and the delivery address to which the items will be sent.<\/p>\n<p>It is the Customer\u2019s responsibility to verify the accuracy of the personal information and to promptly notify L\u2019Agor\u00e0 di L. Consoli of any changes to be made. L\u2019Agor\u00e0 di L. Consoli undertakes to describe and represent the items sold on the website in the best possible way.<\/p>\n<p>Nevertheless, some variations between the images of the product depicted on the website and the actual product may occur.<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>ARTICOLO 4 &#8211; AVAILABILITY OF PRODUCTS<\/b><\/span><\/p>\n<p class=\"p1\">The availability of the product refers to the actual availability at the time the Customer confirms the order.<br \/>\nIf for any reason the item should no longer be available once the order has been confirmed, the customer will be immediately notified by email and the order will be canceled. Any sums paid will also be reimbursed in a timely manner.<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>ARTICOLO 5 &#8211; PAYMENT METHODS<\/b><\/span><\/p>\n<p class=\"p1\">Method of payment can be made by the noted credit cards as indicated on the website <a href=\"http:\/\/www.lagorataormina.com\"><span class=\"s1\">www.lagorataormina.com<\/span><\/a>, bank transfer or PayPal transaction.<\/p>\n<p class=\"p1\">All personal information relating to payment, credit card details and personal data are security protected.<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>ARTICOLO 6 &#8211; Prices<\/b><\/span><\/p>\n<p class=\"p1\">All sales prices of the products indicated on the website <a href=\"http:\/\/www.lagorataormina.com\"><span class=\"s1\">www.lagorataormina.com<\/span><\/a> are expressed in Euros and include VAT, and where applicable the WEEE contribution.<\/p>\n<p class=\"p1\">Shipping costs are not included in the purchase price but will be calculated and indicated prior to payment.<\/p>\n<p class=\"p1\">The Customer accepts the right of L&#8217;Agor\u00e0 di L. Consoli to change its prices at any time, however the goods will be invoiced on the basis of the prices advertised on the website at the time the order is created and will be outlined in the confirmation email sent by L&#8217;Agor\u00e0 di L. Consoli to the Customer.<\/p>\n<p class=\"p1\">In the event of a technical or manual issue causing the retail price shown to make it either inordinately high or derisorily low, the purchase order will be considered invalid and cancelled, and the amount paid by the customer will be refunded within 14 days from the day of cancellation.<\/p>\n<p class=\"p1\"><strong><span class=\"s1\">ARTICOLO 7 &#8211; <\/span>RIGHT OF WITHDRAWAL<\/strong><\/p>\n<p class=\"p1\">In accordance with the legal provisions in force, the Customer has the right to cancel the purchase for any reason without penalty within 14 days from the date of receipt of the products.<\/p>\n<p class=\"p1\">The Customer who intends to exercise the right of withdrawal must notify L\u2019Agor\u00e0 di L. Consoli by means of an explicit declaration containing the decision to cancel the contract.<\/p>\n<p class=\"p1\">In case of exercising the right of withdrawal, the Customer is required to return the goods within 14 days from the day on which it was communicated to L\u2019Agor\u00e0 di L. Consoli the intent to withdraw from the contract pursuant to art. 57 of Legislative Decree 206\/2005.<\/p>\n<p class=\"p1\">The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment) and complete with the attached tax documentation to L&#8217;Agora di L. Consoli, Corso Umberto I, N\u00b0 133, Taormina (Me) 98039.<\/p>\n<p class=\"p1\">Without prejudice to the right to verify compliance with the above, L\u2019Agor\u00e0 di L. Consoli will refund the amount of the products within a maximum period of 14 days.<\/p>\n<p class=\"p1\">The customer can use any means of shipping to return the goods.<span class=\"Apple-converted-space\">\u00a0 <\/span>All shipping costs will be at the Customer\u2019s expense (art 56 co. 2 legislative decree 206\/2005).<\/p>\n<p class=\"p1\">As required by art. 56 paragraph 3 of Legislative Decree 206\/2005, amended by Legislative Decree 21\/2014, L &#8216;Agor\u00e0 di L. Consoli may suspend the reimbursement until receipt of the goods or until the Customer demonstrates evidence that product was returned to L &#8216;Agora di L. Consoli.<\/p>\n<p class=\"p1\">Refund will be made using the same method of payment by the Customer at the time of purchase.<\/p>\n<p class=\"p1\">In the case of cancellations for payment made by cash-on-delivery or bank transfer, bank details must be provided to L &#8216;Agor\u00e0 di L. Consoli through the Contacts section of the website: IBAN, SWIFT and BIC as necessary for reimbursement.<\/p>\n<p class=\"p1\"><strong><span class=\"s1\">ARTICOLO 08 &#8211; <\/span>DELIVERY METHODS<\/strong><\/p>\n<p class=\"p1\">The products will be shipped by express courier to the address indicated by the Customer as soon as practicable and no later than 20 days from the time of the order confirmation email as issued by L \u2019Agor\u00e0 di L. For orders of equal or greater amount, shipping will be free of charge.<\/p>\n<p class=\"p1\">Insured shipping has a cost equal to 2% of the value of the goods.<span class=\"Apple-converted-space\">\u00a0 <\/span>We recommend this service as protection for valuable item, guaranteeing additional peace of mind in case of direct and material damage that may occur during transport.<\/p>\n<p class=\"p1\">Shipping to the EU<\/p>\n<p class=\"p1\">For orders whose total amount is less than \u20ac 1,000.00 a charge of \u20ac 40.00 is required for packaging, shipping and transport costs. Consoli informs the Customer of the possibility to disable the creation of such files by accessing the Internet configuration menu.<\/p>\n<p class=\"p1\"><span class=\"s1\"><b>ARTICOLO 12 &#8211; INTEGRITY<\/b><\/span><\/p>\n<p class=\"p1\">These General Conditions of Sale consist of all the clauses that make them up.<\/p>\n<p class=\"p1\">If one or more provisions of these General Conditions of Sale are considered invalid or declared as such pursuant to the law, regulation or following a decision by a court with jurisdiction, all other provisions will continue to retain full force and effect.<\/p>\n<p class=\"p1\"><strong><span class=\"s1\">ARTICOLO 13 &#8211; <\/span>APPLICABLE LAW AND COMPETENT COURT<\/strong><\/p>\n<p class=\"p1\">The sales contract between the Customer and L.
